Cannabis in Delaware So Far
In April 2023, Delaware Governor John Carney allowed House Bills 1 and 2 to become law without his signature, establishing the foundation for a legal adult-use market in Delaware:
- These state bills legalized personal possession and outlined a regulatory framework for adult-use sales under the state’s Office of the Marijuana Commissioner.
- Despite Delaware’s cannabis legalization, the market has seen slow implementation and regulatory hurdles, such as with distributing cannabis business licenses.
- In February of 2025, the state announced key legislative updates and the beginning of its adult-use license lottery process.
- This revised policy plan states that the Delaware Office of the Marijuana Commissioner will award 125 adult-use licenses across various facets of the industry, including retail, cultivation, manufacturing, and testing.
- Application processes, background checks, governmental signoffs, and other administrative efforts have caused immense setbacks despite the OMC’s policy revisions.
Consequently, these policy delays and administrative hurdles have left anticipating entrepreneurs and cannabis brands feeling stuck and frustrated.
Delaware’s Legal Market Is Now Open
No matter the challenges Delaware has faced, the state continues to push onward and upward. Following the lead of other legalized states, Delaware established a lottery-based application process for its cannabis licensing system, according to the Marijuana Policy Project (MPP).
For dispensaries and cannabis retailers, this is a fair, non-monopolized opportunity to enter the new market. It also opens space for social equity applicants and small-farm operators.
Two years after legalization, as of August 1, 2025, Delaware’s adult-use cannabis market is finally open. Anyone over the age of 21 can now purchase legal cannabis starting in 12 medical cannabis dispensaries.
Delaware’s legal market will include a wide range of cannabis products, including flower, gummies and other edibles, vapes, capsules, and tinctures.
You can buy and possess up to one ounce (28.35 grams) of flower at one time, or 750 mg of concentrates. You can buy more than one ounce by making multiple purchases, as long as you give away any amount above an ounce. Sharing is caring, after all.
Is This Launch Good For Everyone?
Delaware has talked a big game about making things fair, and while the state is excited to kick off the legal market, some advocates are warning consumers to hold off purchasing adult-use cannabis until retail-only licensees open, which could be several months from now.
There are currently 30 prospective retailers with conditional approval, but final approval for each one depends on whether or not they find a retail location and meet the state’s legal requirements.
Cannabis advocate Zoë Patchell says that medical dispensaries are getting an unfair advantage. “It’s incredibly unfair and disappointing that six exclusive businesses who have publicly lobbied for less competition and unfair competitive advantages get to start sales ahead of all the new adult use businesses,” Patchell told WHYY.
“These six businesses ended up with first sales and absolutely no competition. This is not what the people were promised and it’s not what the people supported,” she added.
On the flip side, Delawareans who are not medical marijuana cardholders finally have access to cannabis. The hope is that Delaware will use this momentum to push retail licensees forward, and the full, thriving market that the state has been waiting for will be in full swing.
